Your guide to the terms for a relaxed experience

These Terms and Conditions (“Terms”) govern your use of FishNChill.com (“Website”) and participation in any freediving courses, retreats, training sessions, or purchase of merchandise provided by FishNChill (“we”, “us”, “our”).

By using this Website or participating in any FishNChill activity, you confirm that you have read, understood, and agreed to these Terms in full.

  1. COMPLIANCE WITH TRAINING & SAFETY STANDARDS

FishNChill freediving courses and activities are conducted in alignment with:

  • AIDA International training and safety standards

  • Recognized freediving best practices

All participants agree to comply with:

  • Instructor instructions at all times

  • Safety protocols, buddy procedures, and depth limits

  • Course-specific standards and progression requirements

Failure to comply may result in removal from activities without refund, for safety and insurance compliance reasons.

  1. ELIGIBILITY & PARTICIPANT RESPONSIBILITY

  • Participants must be 18 years or older, or provide written parental or legal guardian consent.

  • Participants must be capable swimmers and comfortable in open water environments.

  • Certification courses may have minimum performance and skill prerequisites.

FishNChill reserves the right to refuse or discontinue participation if a participant is deemed unfit or unsafe to continue.

  1. MEDICAL FITNESS DECLARATION

By participating, you confirm that:

  • You are in good physical and mental health

  • You have truthfully disclosed all relevant medical conditions

  • You have completed any medical questionnaire required by AIDA or FishNChill

You acknowledge that freediving places significant physiological stress on the body and that failure to disclose medical conditions may result in serious injury or death. FishNChill does not provide medical supervision, diagnosis, or treatment.

  1. ASSUMPTION OF RISK

Freediving, breath-hold diving, spearfishing, and water-based activities involve inherent and unavoidable risks, including but not limited to:

  • Shallow water blackout

  • Hypoxia and loss of consciousness

  • Drowning

  • Barotrauma and lung squeeze

  • Decompression illness

  • Equipment failure

  • Severe injury or death

You freely, knowingly, and voluntarily assume all risks, whether known or unknown, foreseeable or unforeseeable.

  1. RELEASE OF LIABILITY & WAIVER

To the fullest extent permitted under Canadian law, you release, waive, and forever discharge FishNChill, its owners, instructors, assistants, contractors, volunteers, and affiliates from any and all claims arising from participation in FishNChill activities.

This includes claims arising from:

  • Negligence (except where prohibited by law)

  • Instructor decisions made in good faith

  • Environmental conditions

  • Equipment use or failure

You acknowledge that this waiver is binding, that you understand its legal effect, and that you are waiving certain legal rights.

A separate signed liability waiver will be required prior to participation.

  1. INSTRUCTOR AUTHORITY & SAFETY DECISIONS

All FishNChill instructors have full authority to:

  • Modify or cancel sessions

  • Enforce depth, time, and performance limits

  • Remove participants from activities

These decisions are final and made in the interest of safety and insurance compliance.

  1. COURSES, CERTIFICATION & STANDARDS

  • Certification courses follow AIDA & PADI International standards

  • Certification is not guaranteed

  • Additional training sessions may be required

Failure to certify does not entitle participants to a refund.

  1. RETREATS, TRAVEL & INSURANCE

Unless explicitly stated:

  • FishNChill does not arrange flights or independent accommodations

  • Participants are responsible for travel logistics and documentation

Participants are strongly encouraged to carry:

  • Freediving-specific accident insurance

  • Medical and evacuation insurance

  • Travel insurance

  1. PAYMENTS, CANCELLATIONS & REFUNDS

Courses & Retreats:

  • Payment confirms booking

  • Refund policies are disclosed at booking

  • No refunds for missed sessions, early departure, or medical disqualification

Merchandise:

  • Returns accepted within [X] days if unused and in original condition

  • Shipping costs are non-refundable unless legally required

  1. INTELLECTUAL PROPERTY

All Website content is protected under Canadian intellectual property law. Unauthorized use is prohibited.

  1. CODE OF CONDUCT

Participants must:

  • Act respectfully toward instructors and fellow participants

  • Refrain from reckless or unsafe behaviour

  • Follow all safety and environmental guidelines

Violations may result in immediate removal without refund.

  1. LIMITATION OF LIABILITY

To the maximum extent permitted by law, FishNChill shall not be liable for indirect, incidental, or consequential damages arising from use of the Website or participation in activities.

  1. INDEMNIFICATION

You agree to indemnify and hold harmless FishNChill from any claims arising from your participation, misconduct, or breach of these Terms.
